Heightened concern over lawyer conduct has lead to new State Bar “Guidelines of Civility and Professionalism” and extensive amendments to the Code of Civil Procedure, the California Rules of Court and the Rules of Professional Conduct. New cases have also substantially revised long-established procedures in civil litigation. Lawyers need to be familiar with the new requirements in order to protect themselves and their clients.
This seminar will focus on lawyers' responsibilities to their clients in civil cases. We will also discuss the Rules of Professional Conduct as they pertain to lawyer advertising and civility, and the continuing problem of substance abuse by lawyers.
The panel will also explore ways to deal respectfully and effectively with the court when rulings are made from the bench. In particular, the panel will discuss how recent changes in summary judgment procedure have affected judges’ responsibility to rule on objections to evidence and what role lawyers properly should play in this process.
